SETTING PREFERENCES; SCHEDULING REAC INSPECTIONS

In this month's feature, we discussed what you need to know about complying with HUD regulations on giving preference on admissions to certain categories of applicants. We pointed out that HUD views the process of assigning preferences to applicants who meet certain criteria as an effective way to provide housing opportunities to those with the greatest needs. Remember, under these HUD regulations, you do not have to establish any admissions preferences at all—it's entirely up to you.

But keep in mind that using any admissions preference is separate from HUD's requirement that you give priority to “extremely low-income” households, which are defined as those making 30 percent or less of your area's median income.

In our article on new guidelines for scheduling REAC inspections, we told you about the revised set of standards issued by the REAC Reverse Auction Program (RAP) in October 2010 for inspections of multifamily and public housing sites. We discussed how REAC inspections get started, restrictions on scheduling, and other very important matters. In addition, remember that there are only two exceptions to the RAP program—Puerto Rico and New York Housing Authorities, which are governed by their own special protocols.

ANSWERS & EXPLANATIONS

QUESTION #1

Correct answer: a

Applicants qualifying for preferences are selected from your waiting list. Preferences affect only applicants' order on the list, and cannot make anyone eligible who was not already eligible. You must inform all applicants about available preferences that you use and give all applicants an opportunity to show that they qualify for them.

QUESTION #2

Correct answer: b

In addition to the displacement requirements regarding BMIR sites, HUD also says that owners of Section 236 sites give preference for those displacements.

QUESTION #3

Correct answer: c

If you want to use a local preference, such as for military veterans, you must submit a written request to the HUD Field Office, describing the specific state or local law and requesting HUD's concurrence on your use of the preference.

QUESTION #4

Correct answer: b

You cannot just implement a residency preference without keeping certain factors in mind. For example, you must never adopt a residency requirement, which means that you refuse to lease to any applicant who doesn't live in the specified geographic area. In addition, you may not use a residency preference for the purpose of delaying or denying admission based on the race, color, ethnic origin, religion, or disability of any members of an applicant's household.

QUESTION #5

Correct answer: b

The REAC contractor/inspector has 15 calendar days from the date the inspection is awarded in which to schedule a REAC inspection. If the REAC inspection is not scheduled within 15 days, the REAC inspection must be recorded as “Uninspectable,” with the reason.

QUESTION #6

Correct answer: a

REAC contractors/inspectors should give the authorized site representatives the choice of at least three scheduling dates. However, this may not be feasible due to the travel schedule of the REAC inspector.

QUESTION #7

Correct answer: c

There are times when a REAC inspection is canceled by HUD. If that occurs, the REAC contractor/inspector is responsible for notifying the authorized site representative. In addition, if there is a Severe Weather Advisory, the REAC inspection will be rescheduled. However, if there is snow, the REAC inspection will still be held.

QUESTION #8

Correct answer: b

It's good policy to provide the REAC inspector with your cell phone number. For example, the cell phone number will enable the inspector to contact you in the event of a Severe Weather Advisory, or if he or she will be late due to unforeseen circumstances. Finally, it's also important that you provide directions to the site or to an alternative meeting place if the location of the site is difficult to find.
